When I welches looking to join a firm coming from a federal clerkship, I was very intentional about joining one that made frequent court appearances and showed confidence in its associates by letting them atte nd and participate. Once I joined the firm, I did everything I could to be an expert in my cases- to know all the facts cold and to understand all of the legal issues in the case. What type of advocacy training have you had?At MoloLamken, associates take the NITA courses on depositions and trial skills within their first year. In the trial skills course, we conducted a full mock trial before a jury of local high school students, who gave feedback after the trial. Beyond that, Ive observed other lawyers in court whenever possible, which has had a huge impact on my understanding of successful advocacy.3. What were your big takeaways from the NITA experience?First, preparation is key for all stand-up experience. There are tons of variables in court. You can cut down on the possibility of things going wrong if you stay on top of the things within your control. Because you never know for certain what answer a witness will give to a question, you also need to be prepared so you can adapt to things going differently than expected.Second, the most effective advocates know their material well and deliver it in a clear and direct manner. While several different styles of advocacy can be effective, they all have that one thing in common delivering on the substance.4. What was the first time you spoke in a courtroom?My first significant courtroom experience was arguing some of our motions in limine in a white-collar criminal matter that was about to go to trial when I had been at the firm for about three months.5. What did you do to prepare for that?In preparation for that argument, I carefully reviewed the motions, the facts at issue, and the relevant cases. Our team prepared a list of probable questions to be prepared for, and we mooted the argument. 6. How much of courtroom success is preparation, and how much is performance? Performance and preparation are dependent upon each other. Being well prepared on the facts, issues, and law in your case will lead to a strong performance. Certainly there are some performance issues, like voice projection, that may need to be ironed out, but if youre well prepared, those performance issues can be easily and quickly addressed.For example, I know that I have a tendency to speak quickly when nervous. By focusing on preparation, I can minimize my nervousness. When Im on my feet, I can then focus more of my attention on my delivery because I will be well prepared on the substance.We have courtrooms in our offices and use them all the time to moot arguments and work with witnesses. Our general rule is that any argument of substance gets mooted at least twice. Those moots help you understand any areas that need to be addressed before standing up in court.7. Should associates be looking to get staffed on certain types of cases to increase the chance of getting some air time in court?Obviously, associates are constrained by what types of cases their firm handles. MoloLamken is involved in some of the most important criminal and civil cases in federal and state courts across the country but will sometimes take a smaller case if its of interest to the firm. Associates shouldnt assume that just because its a big case, they will not get good experience. If you become indispensable to your case, no matter how big or small, you will end up with better opportunities. For example, I was the associ ate on a six-week jury trial in federal court with more than fifty witnesses- a very large case. Even though it was a large case, I was still able to do short cross examinations on some of the smaller witnesses in the case.8. Taking or defending a deposition is not the same as being in court, but can that experience be helpful?Yes. Of course, many associates are focused on getting into court, but much of the action happens at the deposition table. You will learn a ton about your case through taking and defending depositions. Its also a great way to demonstrate your value to the case team, to learn how to deal with witnesses, and to practice making objections. Deposition skills also transfer to the courtroom. When taking a witness at trial, you will need to carefully frame questions, pay attention to the witness answer, and ask necessary follow-up questions to get to the answer you need, just like you would at a deposition. And depositions lay the base for trial testimony. If youre a sking good questions in your depositions, there should be no surprises at trial. 9. What about pro bono cases? Can you get meaningful experience that will accredit you with paying clients?Absolutely. Many associates at MoloLamken have their first major stand-up experience doing pro bono work. Once you have had that experience, clients are much more comfortable with you handling those aspects of their cases. Weve had associates argue a pro bono appeal before the Seventh Circuit and then use that experience to succeed when arguing cases for paying clients.10. What was your most recent experience in court?fruchtwein recently, I had a four-day bench trial in Illinois state court. It was a relatively small case for a major corporation, with six live witnesses. I cross-examined the other sides main witness and did the direct examinations for three of our four witnesses. The associate on the case was also able to take two witnesses, one on direct and one on cross. There was also a lot of a rgument on motions and evidentiary issues during the case, which the associate and I split up, as well.11. What are you working on now thats likely to get you in a courtroom next?Right now, we have several cases that will provide some courtroom experience. We are defending a major corporation in a taxpayer derivative suit involving claims of fraud and breach of fiduciary duty. We may have some argument over amended pleadings in that case. In addition, we represent a shareholder of a public corporation in a securities class action, where there will likely be some argument in the early stages of the case. And we have a case for a major corporation in a shareholder derivative suit, where we are in discovery and will be approaching summary judgment within the next few months.12. What are your top tips for associates in private practice looking for courtroom experience? The first advice I give any new associate is to become indispensable to your case. Immerse yourself in the facts, and b ecome an expert in the law. That’s why they’re often let go ahead of the folks below them - folks like you.To capitalize on this situation, I turn to one of my golden rules: “Know your boss’ boss as well as you know your direct boss.”When times are tight, high-priced executives become disposable. Their superiors (including owners and board members) conclude they can save money by putting in a “caretaker” boss, perhaps a former subordinate of the person fired. The company gets two jobs done for the price of one.If you’re the one tapped for promotion, congratulations! But what if you’re not?What if it is your close friend?It could be your peer in the next cubicle. Or it may be a friend from another department, or even worse, someone you helped get a job at the company. It could even be a manager you were already friends with but did not report to in the past. Now, under this consolidation, that person may have been given several departments to manage, including yours. So now you are reporting to your friend who never managed your department before.In today’s dog-eat-dog economic environment, reporting to a friend may not be as easy as it would have been in smoother times. Remember: The closer you are to the top, the closer you usually are to the door. And no one wants to be the next one out.Here are my bulletproof ground rules for dealing with a friend who just become your boss:1. Remember that he’s the boss. Your friend has his own job on the line. “Friendship” is just a word. It’s like the saying “blood is thicker then water.” 2. Don’t flaunt your friendship with your friend. She may be doing two or more jobs, and she will be counting on your friendship and, more importantly, loyalty. You may not want peers in the same department even to know you have a personal relationship. It can get very sticky. They will resent it, and it will backfire on both of you. Don’t ask for special favors. 3. Tell him you’re proud of him. Congratulate him first thing, and let him know that you want to see him shine. Ask what can you do to make his job easier and transition faster. 4. Let your friend, now your boss, “take the lead.” Wait for her to determine what her priorities are - your friendship or being the boss. After all, she is in the driver’s seat. Your opinion is fine, but she’s now the “new boss,” and she’s calling the shots. 5. Maybe, just maybe, give him a copy of your resume. This would apply, even if the person who is the new boss were not your friend. Often we are at a company for a long time, and even our boss - new or not - really doesn’t remember our experience. Having an up-to-date resume at all times helps people understand how you have grown. (If you need a leg up consider working with certified resume writing services.) In this case, your friend may know your children’s birthdays and that your mother-in-law is a pain, but he may not know you have two master’s degrees and experience managing a team yourself from a previous job. Executives want to be the “cool parents” to their employees and also free up HR teams to focus on strategic decisions instead of tracking paid time off (PTO). Businesses can offer unlimited vacation, but they should track PTO if they want to ensure that their vacation policy actually has a positive impact on their workplace. You might think that employees would abuse this generous leave policy, but the opposite is actually true. Unlimited PTO usually leads to staff taking less vacation and fewer paid days off, a problem that is only exacerbated by a lack of tracking and accountability. When the guardrails are removed, employees grow more cautious and fearful, and rarely take full advantage of unlimited policies. Instead, they make judgment calls based on what they think makes them look better to their managers, regardless of their impact on their own wellbeing. Automating PTO Processes Is a Solution to the Problem The most effective strategy for encouraging employees to take time off while improving HR’s workload is actually automating PTO processes, not opting out of oversight altogether.   Employees need to know that their bosses don’t see them as tireless workers or cogs in the machine. They want to be valued for their contribution to the company but also have their personal life and boundaries respected. Getting this feedback right for executives and HR teams is a challenge. This will allow employers to gather data and evidence to support internal communications with employees when concerning trends are spotted. This is particularly important in the U.S. Employees Fear Seeming Expendable to Their Employers American workers are especially addicted to work and are afraid of appearing expendable to their employer. Many are also guided by the unhealthy belief that vacations are a sign of weakness instead of a necessary part of work-life balance. A Center for American Progress study found that a lot of employees believe taking too many days off work would cost them bonuses, promotions, and even their jobs. A Project Time Off report found that more than half of Americans don’t use all of their vacation days. That same study found roughly 1 in 4 Americans had not taken a vacation day in over a year. Of those surveyed, the most commonly cited reason for not taking time off was the fear of being replaced.  Working long stretches without breaks is often unhealthy, harmful, and even downright dangerous to employees. A number of clinical studies found that poor vacation habits can actually kill you. A State University of New York study’s research found that cardiovascular disease patients who didn’t take annual week-long vacations were 30% more likely to die from their condition. The Helsinki Businessmen Study concluded that vacations improve longevity in working adults, and the Journal of Happiness Studies’ research showed that time off is enormously beneficial to mental health. Predictably, employees who continuously overwork themselves and fail to take adequate time away from the office are less happy and less healthy than their more balanced peers. Organization Can Lose When Employees Have Unlimited PTO Businesses also stand to lose from vacation-phobic employees. When employees burn out from being overworked, their productivity suffers, their health can decline and usually, staff who are unexpectedly absent from the office increases. According to a Liberty Mutual analysis of U.S. Bureau of Labor Statistics, the US economy loses $100 billion annually to employees’ absenteeism. Circadian, a workforce solutions company, estimates that absenteeism costs U.S. companies about $3,600 a year for hourly staff and at least $2,600 for salaried. It’s clear that employees skipping vacations poses serious problems, problems only amplified by untracked, unlimited PTO policies. When people are not given parameters around acceptable PTO practices, they succumb to peer pressure, take fewer breaks and shorter vacations. Organizations Are Understanding the Limitations of Unlimited PTO Businesses are starting to catch on and, after realizing the danger of unlimited, untracked time off, they are appropriately adapting their policies.
